Article 1 Definitions
In these Terms and Conditions the following definitions apply
Cooling off period
The period during which the consumer may exercise the right of withdrawal
Consumer
A natural person not acting for purposes relating to trade business craft or profession who enters into a distance contract with the merchant
Day
Calendar day
Fixed term contract
A distance contract relating to a series of products and or services for which delivery and or purchase is spread over time
Durable data carrier
Any tool that enables information to be stored in a way that allows future consultation and unchanged reproduction
Right of withdrawal
The consumers right to dissolve the distance contract within the cooling off period
Merchant
The legal entity that offers products and or services to consumers at a distance
Distance contract
A contract concluded without the simultaneous physical presence of consumer and merchant using distance communication only
Means of distance communication
Any means that can be used to conclude a contract without being physically present together

Article 3 Applicability
These Terms and Conditions apply to every offer made by the merchant and to every distance contract concluded between merchant and consumer
Before concluding a distance contract these Terms and Conditions are made available to the consumer or can be provided free of charge upon request
If additional product or service specific terms apply the consumer may rely on the provision most favorable to them in case of conflict
If any provision is invalid the remaining provisions remain effective and will be replaced by a provision closely reflecting the original intent
Article 4 The Offer
Offers are non binding and subject to availability
Descriptions are accurate but indicative
Images aim to represent the product but colors may vary
Obvious errors do not bind the merchant
Each offer contains information about
Price excluding import taxes duties or customs fees
Shipping costs if applicable
Payment and delivery methods
Right of withdrawal if applicable
Languages in which the contract is concluded
Duration of the agreement if applicable
Article 5 The Agreement
The agreement is concluded at the moment of acceptance by the consumer
Electronic acceptance is confirmed electronically
The merchant may refuse an order based on legal grounds
Each agreement is subject to product availability
Article 6 Right of Withdrawal
Consumers have the right to withdraw within 30 days without giving reasons
The cooling off period starts the day after receipt
Products must be returned in original condition where reasonably possible
Return proof is required
If no withdrawal is communicated within the timeframe the purchase is final
Article 7 Costs in Case of Withdrawal
Return costs are borne by the consumer
Refunds are processed within 14 business days after receipt of the returned item
Article 8 Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for
Personalized items
Hygienic goods if opened
Items that deteriorate rapidly
Sealed audio video or software once opened
Article 9 Price
Prices are valid during the stated offer period
Price changes due to legal regulations are allowed
Import taxes VAT and customs fees are the responsibility of the recipient
Typographical errors do not bind the merchant
Article 10 Conformity and Warranty
Products conform to reasonable usability and reliability standards
Warranty corresponds with manufacturer warranty
Warranty does not apply to misuse or unauthorized alterations
Article 11 Delivery and Performance
Orders are executed with due care
Delivery occurs at the address provided
Maximum delivery time is 30 days unless agreed otherwise
Risk transfers upon delivery to the consumer
Article 12 Duration Transactions
Open ended contracts may be terminated with one month notice
Fixed term contracts end after their agreed duration
No automatic renewal without consumer consent
Article 13 Payment
Payment is due upon checkout
Incorrect payment data must be reported immediately
Reasonable collection costs may apply in case of default
Article 14 Complaints Procedure
Complaints must be submitted within 7 days of discovery
Responses are provided within 14 days
Valid complaints may result in replacement or repair

These Terms and Conditions are governed by the laws of the State of South Carolina USA
Jurisdiction lies with the competent courts in South Carolina unless mandatory law provides otherwise
